Waiver

Acknowledgment and Assumption of Risks

I, the undersigned, voluntarily choose to participate in the Yoga and Art Retreat offered by The Meraki LLC. I understand and acknowledge that:

  1. Participation in this art activity involves the use of various materials and tools, including but not limited to glue, paints, scissors, pencils, and pens, which may pose risks. These risks include but are not limited to:

    • Skin sensitivity or allergic reactions to paints, glue, or other materials.

    • Accidental cuts, scrapes, or minor injuries from tools such as scissors.

    • Accidental ingestion or inhalation of materials.

  2. Yoga and art activities involve physical movement that may carry inherent risks, including but not limited to physical injury, emotional distress. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.

  3. I am responsible for assessing my physical and mental ability and or/ to consult a doctor with an understanding of art and yoga to check that I am sufficiently fit and healthy to undertake these classes and other physical activities that you may choose to do whilst on the retreat.

  4. I agree to notify the retreat organizers of any medical conditions, allergies, or concerns that could affect my participation. If I have health conditions and dietary requirements that may be affected by the activities offered on the retreat The Meraki reserves the right to advise me to desist and in the interests of my health, or others, and may decline my stay at the retreat.

  5. Whilst all measures are taken to ensure a high standard of health and safety, I will be situated in the countryside where the land is uneven and The Meraki shall not be responsible for any injuries caused by uneven terrain.

 

Health and Safety

  1. I affirm that I am in good physical and mental health and have consulted a healthcare provider if necessary to confirm my fitness for yoga, art, and related retreat activities.

  2. I agree to follow all instructions provided by instructors or facilitators during the retreat and will inform them immediately if I experience any discomfort or need to modify my participation.

  3. I understand that organizers are not liable for injuries, medical conditions, or emergencies arising from my participation.

 

Release of Liability

  1. I release The Meraki LLC, its owners, instructors, staff, and venue partners from all liability for any injury, loss, or damage incurred during the retreat, whether due to negligence or otherwise.

  2. I waive my right to make claims, file lawsuits, or demand compensation from the aforementioned parties for any personal injury, property damage, or other harm arising during the retreat.

  3. I release The Meraki LLC, its owners, instructors, staff and venue partners from all liabilities for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.

  4. I release The Meraki LLC, its owners, instructors, staff and venue partners from all liabilities for any theft or loss of property at any time during the stay at the SkyTop Lodge during the retreat period. It is your responsibility to ensure that your possessions are kept safe at all times. This includes but not limited to rental cars or other rental equipment.

Terms & Conditions

  1. Your booking is not considered definite and no contract will exist until we receive the the payment. By booking a retreat with The Meraki LLC you are accepting these terms and conditions.

  2. Please note, we do not share customer details with any third parties.  This information is used only for administration and execution of the retreat. This privacy policy does not cover the links within this site linking to other sites.

  3. Where a booking is made on behalf of several individuals the booking is conditional on the person(s) paying having authorization from all the individuals named on the booking form to enter into this contract. The terms of this contract will apply to each member of the group as though they had paid for their own retreat individually and directly to us.

  4. Occasionally, changes may have to be made (e.g., art teacher, yoga instructor, class times or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar standard and inform you as early as possible.

Payment Dues

  1. At the time of booking full payment needs to be made, and $300 will be a non-refundable deposit . Your booking is not considered definite and no contract will exist until we receive the initial non refundable deposit.

  2. Full payment needs to be made by Feb 28, 2025, no exceptions.

  3. 100% refundable if cancelled by Feb 28, 2025 (exclusion is the deposit).

  4. You (or any member of your party) may cancel your booking at any time, provided that the cancellation is made by the person submitting the booking form and is notified to us in writing. Cancellation will take effect the day such notification is received by us.

  5. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim on your own insurance.

  6. We reserve the right under certain circumstances to cancel the retreat. In particular our retreats require a minimum number of at least 75% participation to be booked 45 days before the start date. If this minimum number is not reached, we may cancel and refund you 100%.

  7. Refunds may take up to two business weeks.

 

Your Payment Inclusions & Exclusions

  • A shared room between two people

  • Breakfast, Lunch, Dinner, Afternoon tea/coffee (for details on the program, meals coverage through the 2 days refer to the program page)

  • Yoga classes with Reena Singhvi

  • Art session with The Meraki

  • Exclusions:

    • Transportation to and from SkyTop Lodge

    • Events other than the yoga and art

    • Drinks or additional meals

 

Rooms, Meals & Complaints

  1. If you have a preferred guest to share room with please provide through the form and we will group them together. If no name is provided we will partner you with a participant. 

  2. Once a room has been assigned to you, it cannot be changed.

  3. The Meraki will not be held liable to any damage to the rooms and the guest/you will be required to pay for any damages.

  4. If the guest/you have any issues with the room, you need to resolve with the at SkyTop Lodge representatives and collaborate with your roommate.

  5. d. If you have a problem during your retreat, please inform the retreat host immediately and she/he will endeavor to put things right. Please note that we cannot be held responsible for the individual behavior of any group member or other guest sharing your accommodation.

  6. e. All meals will be preselected by the SkyTop Lodge, if there are any dietary restrictions that the preselected menu does not accommodate, please address them directly with SkyTop Lodge. Please fill out the details of allergens and restrictions during registration, we will share with SkyTop Lodge in advance.

  7. Any other food or beverage purchases outside of the preselected menu will not be covered by The Meraki. 

 

Travel Arrangements

  1. All travel arrangements are your responsibility and at your own cost including any transfers. The Meraki LLC shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. 

 

Alcohol

  1. We do not permit the consumption of alcohol before and during the retreat plan of the day. Our retreats are aimed at providing and facilitating activities in line with health and wellness, and therefore consumption of alcohol during/in our retreats classes is not permitted.

 

Covid 19

  1. If you develop Coronavirus symptoms while on the retreat, your host will assist you to get medical attention as soon as possible.  It is important that you have travel insurance that covers medical costs incurred due to Coronavirus as all expenses for testing, treatment or self-isolation will need to be covered by you.

  2. If you experience symptoms of COVID-19 before you are due to travel to the retreat, it is your responsibility to carry out a test. In the case of a positive test, you will not be permitted to attend a retreat. If you cannot travel to the retreat because you are experiencing symptoms of COVID-19 and need to self-isolate, inform us as soon as possible. In the case that you cannot travel due to testing positive with COVID-19 or needing to self-isolate due to experiencing symptoms, we cannot offer any refunds and it is your responsibility to obtain adequate travel insurance to cover your costs in the case of no longer being able to attend the retreat.

  3. If you begin to experience symptoms of COVID-19 with us while on a retreat, you must inform your retreat host immediately. If your retreat needs to be cut short due to needing to travel back home, we cannot offer any refund or credit note for the days missed or cancelled.

 

Recommendations

  1. Travel insurance is highly recommended. If you choose to buy insurance, please ensure that your travel insurance covers the activities of this retreat as well as unexpected cancellation, sickness, losses and all other risks associated with traveling and taking part in the retreat.
